Scope and eligibility
These terms apply to the ToBase website, console, model API gateway, Playground, workspaces and related billing services. Read these terms and the privacy policy before registering, paying or making requests. If you do not agree, do not use the relevant services. A separate written agreement with us governs matters it expressly addresses.
You must have the capacity to contract required in your jurisdiction and satisfy the selected model provider's age and eligibility requirements. If you use the service for an organization, you must have authority to do so and ensure that people authorized to use the account or workspace understand and follow the applicable requirements.
The gateway and third-party services
ToBase provides unified access and routing; the actual model provider performs inference. Available models, providers, protocols, parameters, context and output limits and prices depend on the service configuration and published descriptions. An alias or route is not a guarantee of a fixed provider, model version or continuous availability.
Use of a provider's model is also subject to its applicable service, content, data and regional restrictions. Choose models and providers appropriate for your use. A unified ToBase interface does not remove upstream restrictions or imply any partnership or endorsement beyond what actually exists.
Accounts and API key security
Sign in with an email address or third-party identity you are authorized to use, and keep necessary contact information accurate. Protect your devices, email, third-party identity and API keys, and configure appropriate model, spending, expiry and IP restrictions. A full key is displayed only when created; if lost, revoke it and create a replacement.
Do not impersonate others, bypass authorization or obtain another person's keys. Revoke affected credentials and contact hello@tobase.ai promptly if you detect misuse or compromise. Requests under your account and keys are billed according to actual processing. Responsibility remains subject to these terms and applicable law; the existence of a request under an account does not excuse any liability the platform must bear by law.
Inputs, outputs and necessary processing
You must have the rights and lawful basis needed to submit and authorize processing of inputs, including appropriate permissions for personal information, images, audio, code or business information about others. You retain your lawful rights in inputs and authorize ToBase to process and transmit inputs and outputs only as needed for the routing, inference forwarding, protocol handling and usage calculation you request.
ToBase does not claim additional ownership of your inputs or outputs merely by forwarding them, and this clause does not grant a model training license. Protection of outputs, permitted uses and third-party rights still depend on applicable law, the actual provider's terms and the content itself. Model outputs may be incorrect, incomplete or similar to other users' results, and require appropriate review before use.
Acceptable use
Do not use the service for fraud, infringement of privacy or intellectual property, unlawful content, unauthorized processing of others' data or other activities that violate applicable law or provider rules. Do not attack, scan or damage systems without authorization, steal credentials, abuse verification codes, payments or invitations, or interfere with other users.
Do not bypass account, model, provider or regional restrictions, evade rate limits, charges or quota controls, or falsify payment or refund facts. If a use requires professional judgment, human oversight or regulatory authorization, you must satisfy those conditions. Model output does not replace required professional services or independent verification.
Workspaces, members and quotas
Keys, balances, bills and request records are managed according to each workspace's ownership and permissions. Workspace owners are responsible for its charges, and administrators manage invitations, removals and quota allocations. Members must use resources only within their authorization. A member's available quota is not the entire workspace balance or separately withdrawable money.
Removal of a member, a permission change or discontinuation of a workspace does not automatically reverse existing usage, refunds or settlement obligations. Shared workspace administrators may view member and usage metadata within their permissions; ordinary members may access only information authorized for them.
Prices, usage and settlement
The service is priced in US dollars (USD). Charges follow the actual model, provider and applicable published token, cache, image, audio, per-request or other billing rules. Applicable tiers, time-based prices and user discounts follow the pricing rules frozen at admission and the settlement evidence. Later price changes do not recalculate historical settled bills.
A request reservation protects available credit and is not final spending. Final charges follow settlement, and display statistics may update later than the financial ledger. Separate requests containing the same content may incur separate charges. A client timeout or disconnect does not prove the upstream did not execute; check request records before deciding whether to retry an uncertain outcome.
Top-ups and payments
Custom top-ups must exceed $0.50 in whole US cents, with a minimum of $0.51 and a maximum of $1,000 per payment. Available payment methods are shown at checkout. Paying $1 provides $1 in platform credit. ToBase does not add a Stripe fee for you or deduct one from the credited amount. Platform credit is for service use, not a deposit, investment or payment account.
Stripe hosts payment processing, and an order belongs to the workspace selected when it was created. Switching pages or workspaces during payment does not change its destination. A return from checkout or a browser success message alone does not establish crediting; the server verifies actual payment before applying credit. If the connection fails or status has not updated, check the original order rather than making another payment solely because the outcome is unclear.
Administrator credits and debits and historical test top-ups are recorded separately from actual payments. Promotional or adjusted credit without payment principal does not automatically create an amount eligible for a payment refund. Records identify each top-up or adjustment's source, amount and status.
Manual refunds, declines and disputes
For a refund or billing concern, contact hello@tobase.ai with necessary reference information such as the order or request ID. The team reviews the matter and processes applicable refunds in Stripe Dashboard; ToBase does not provide refund application, approval or initiation controls. Whether and how a refund is processed depends on the actual payment, spending, dispute facts and applicable law. This clause does not impose a blanket no-refund restriction.
ToBase synchronizes verified declines, refunds and card dispute results. Pending refunds or disputes may hold corresponding credit, and confirmed refunds or recoveries follow the original payment. If insufficient principal remains after spending, a shortfall or debt may arise and restrict further use. Actual refund arrival depends on the payment service and original payment method; platform display status does not replace their confirmation.
Data processing and privacy
ToBase does not persist model request or response bodies or use that content to train or fine-tune models. Necessary usage, billing, security and financial metadata is handled under the privacy policy. The actual model provider processes inputs and outputs under its own rules; a model or channel ZDR flag is not a guarantee that all providers retain nothing or do not train on data.
You are responsible for understanding your authority to submit data and the conditions your use requires. Confirm any required processing region, retention restriction or data processing arrangement with us before submitting relevant data. A unified interface or model name alone does not establish such an arrangement.
Availability and responsibility
To the extent permitted by applicable law, the service is provided as available. Maintenance, networks, capacity, upstream changes and third-party failures may affect availability, latency and output. Unless expressly agreed otherwise in writing, continuous uninterrupted operation, error-free performance, fixed latency and accurate, unique or fit-for-purpose outputs are not promised.
We and users each bear the responsibilities imposed by applicable law. Liability, remedies and consumer rights that cannot lawfully be excluded or limited are not removed by disclaimers or restrictive wording in these terms. A service interruption or account restriction is not a basis to arbitrarily alter existing financial records.
Restrictions, suspension and ending use
We may restrict keys, accounts, models or workspaces as necessary to address compromised credentials, fraud, security risks, debt, unlawful use or violations of these terms or provider requirements. Urgent risks may require immediate action. Where reasonably possible and legally permitted, we will explain the reason and provide a way to contact us for review.
You may stop making requests and revoke your keys. Existing charges, necessary refund and dispute reconciliation and legally required records remain subject to these terms when you stop using the service or request account closure. Contact hello@tobase.ai about account information requests or unused credit.
Changes, disputes and contact
We may update these terms with service changes or legal requirements and will update the date on this page. Material changes to prices, rights, obligations or data processing will be notified in advance through the service or an appropriate contact channel where reasonably possible. Matters requiring separate agreement by law will be handled as required.
Contact hello@tobase.ai first to discuss questions about the service, billing, refunds or these terms. Unresolved disputes may be brought to a competent authority under applicable law. These terms do not exclude mandatory consumer protections, personal information rights or other statutory remedies available to you.
